Terms of Service - HyperCaps

1. Introduction

Welcome to HyperCaps. These Terms of Service ("Terms") govern your use of the HyperCaps macOS application ("App") provided by enugo k.k. ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

2. License and Usage

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with these Terms. The App is licensed, not sold, to you.

You may install the App on macOS devices that you own or control.
You generally may not reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law.

3. Free Trial and Purchase

Free Trial: We offer a fully functional 14-day free trial. You can download and evaluate the software free of charge during this period without any feature limitations.

License Purchase: To continue using the App after the trial period, you must purchase a license. The license is a one-time purchase for a lifetime right to use the version you purchased, including minor updates.

4. Refund Policy

We want you to be completely satisfied with HyperCaps. If you are not satisfied with your purchase for any reason, you may request a full refund within 30 days of your purchase.

While we provide a fully functional 14-day free trial and encourage you to test the software before purchasing, we understand that issues may arise. To request a refund, please contact us with your order details.

5. Payment Processing

Our order process is conducted by our online reseller Paddle or Lemon Squeezy. Lemon Squeezy is the Merchant of Record for all our orders. Payment processing and data handling are subject to the privacy policy and terms of use of the respective payment processor.

6. Disclaimer of Warranties

The App is provided "AS IS" without warranty of any kind, express or implied. We do not warrant that the App will be error-free or that its use will be uninterrupted.

7. Limitation of Liability

In no event shall enugo k.k. be liable for any special, incidental, indirect, or consequential damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to its conflict of law provisions.
